If you reside in the United States and were sent notice by or on behalf of Defendant Bauer Built Inc. that your Personal Information was potentially affected by the April 2023 Data Security Incident discovered by Bauer Built, then you may be a Settlement Class Member and eligible for benefits. Settlement Class membership is determined solely by Defendant’s records identifying the individuals to whom notice of the Data Breach was sent. Excluded from the Settlement Class are: (1) the Judge in this case, and the Judge’s family and staff, (2) Bauer’s officers and directors, (3) anyone who validly excludes themselves from the Settlement, and (4) anyone involved in perpetrating the Security Incident.
If you are a Settlement Class Member and wish to receive Settlement Benefits then you must submit a claim form by December 31, 2026.
Bauer has agreed to provide a range of benefits to the Class. Class Members can claim Credit Monitoring Services and one of the options below.
Credit Monitoring Services. Class Members can enroll in two (2) years of credit monitoring from the three credit bureaus. This benefit comes with $1,000,000.00 in identity theft protection. An enrollment code will be emailed to you.
Option 1: Lost Time, Out-of-Pocket Expenses and/or Losses from Fraud or Identity Theft
Compensation for Lost Time. Class Members who spent time responding to the Security Incident may claim up to four (4) hours, at $25.00 per hour, for a maximum of $100.00 (combined with Out-of-Pocket Expenses as defined below, the combined total is capped at $500.00).
Out-of-Pocket Expenses. Class Members who incurred documented out-of-pocket expenses due to the Security Incident, can get back up to $500.00 (combined with any Lost Time as described above). This benefit covers out-of-pocket expenses like:
Losses from Identity Theft or Fraud. Class Members who incurred documented losses due to identity theft or fraud, can be reimbursed up to $5,000.00. The losses are covered only if they happened after April 16, 2023, and if the loss is a smaller expense, like a charge or a fee, it should be claimed under Out-of-Pocket Expenses, above. For a valid claim you must:
provide proof, like bank statements that show you lost the money and didn’t get it back
explain that the loss was likely because of the Security Incident
show that you tried your best to avoid the loss or to get your money back
If you are claiming for Out-of-Pocket Expenses and/or Losses from Identity Theft or Fraud, you need to submit proof, like receipts or bank statements, to show how much you spent or lost. You can also provide notes or papers you made yourself to explain or support other proof, but those notes or papers alone are not enough to make a valid claim.
Option 2: Alternative Cash Payment. Instead of any of the benefits in Option 1, Class Members can choose to get a one-time $45.00 cash payment. Class Members who elect the Alternative Cash Payment are not eligible to receive benefits under Option 1 but may also claim Credit Monitoring Services.
